Congress created the U Visa for victims of certain crimes who have suffered mental or physical abuse and are helpful to law enforcement or government officials in the investigation or prosecution of criminal activity. The U Visa is available to individuals who are both inside of the United States and outside of the United States. U Visa Basic Requirements:
- You are the victim of qualifying criminal activity.
- You have suffered substantial physical or mental abuse as a result of having been a victim of criminal activity.
- You have information about the criminal activity, or, if you are under 16, certain adult figures may possess the information.
- You were helpful, are helpful, or are likely to be helpful to law enforcement in the investigation or prosecution of the crime. If you are under the age of 16 or are unable to provide information due to a disability, a parent, guardian, or next friend may assist law enforcement on your behalf.
- The crime occurred in the United States or violated U.S. laws.
- You are admissible to the United States (If not you must file Form I-192, Application for Advance Permission to Enter as A Nonimmigrant)

Benefits associated with obtaining U nonimmigrant status include employment authorization, legal nonimmigrant status in the United States and the ability to apply for residency after meeting certain requirements. Additionally, the Form I-192, Application for Advance Permission to Enter as a Nonimmigrant allows immigration officials to waive many grounds of inadmissibility; which would normally result in the denial of an application.
